CHAPTER II - PUNISHMENTS

  1. In calculating fractions of terms of punishment, imprisonment for life shall be reckoned as equivalent to imprisonment for twenty years unless otherwise provided.

Explanation

The punishment of Life Imprisonment is equivalent to 20 years. This 20 years value is used in calculating the fractions for the parole

The Section 6 has not directly addressed period of parole directly, instead it provides a standard method for determining period for parole eligibility.

Example : Accused is sentenced to life imprisonment and he is eligible for parole after serving 1/3 of their sentence. How to calculate the eligible period for parole in this case. Here the life imprisonment is equal to 20 years, so therefore 20 years divided 3 = 6.67 years and this is equivalent to 80 months or 6 years and 8 months.
